Hydroelectric project & Grandfather William Commanda's vision for Victoria Island and the new Endangered Species at Risk Act

If a proposed "Redevelopment of the Hydroelectric Potential of the Existing Chaudiere Island Site (Project)" (on the Ottawa River - The Mighty Kichisippi) is allowed to proceed through "exceptions" to the Ontario's Endangered Species Act, 2007, we will have missed the opportunity to care for "Species at Risk" including the American Eel and also the "Vision of Grandfather/Mishomis/Doctor William Commanda. As of June 16, 2008 please find updates and important information some provided by Bill Allen (a well known activist for the American Eel and a strong supporter of Grandfather Commanda's vision for Victoria Island - a Sacred Meeting Place of many Nations) regarding things that you can do and a process that requires comment and direction to the Minister of the Environment. NOTE new information has been added (June 27/08). It should be noted that folders may be added in order of receiving them but dates should be checked on the documents, for your information.

I am deeply disturbed by the negative decision and its rationale, see many deficiencies and weaknesses in it arguments (elaborated below) and hence, consistent the Guide to EA Requirements for Electricity Projects Section B.4.1.2 Requesting the Minister to Review a Decision by the Director, I request you review and vary the June 6, 2008 Decision on the Domtar Inc. Project – Screening Report Q101794.

Mr. Minister, Good Monday morning. I hope that you are well as we all recall our respective personal ways of observing National Aboriginal Day over the past weekend. Today I have mailed you my request for a Ministerial Review of the letter dated June 6, 2008 from Agatha Garcia-Wright to me (XpressPost LT 357 283 404 CA). Attached is another copy. I am using this communication to provide copies of my request to the proponent and others, including Mr. Bill Sluiman whom I am asking to post the letter as an open letter on the website of the Indigenous Co-operative on the Environment (ICE). I will be sharing my letter with others as the need arises. Ms. Garcia-Wright has not provided me with her e-mail address so I respectfully ask that you forward her a copy of this communication. I wish to request that you review and vary the recent, June 6, 2008, decision (Director’s letter) by Agatha Garcia-Wright, A/Director of your Ministry’s Environmental Assessment and Approvals Branch, regarding Domtar’s proposed reconstruction and expansion project located directly beside historic Chaudières Falls, Ottawa/Gatineau. Domtar should be required to prepare an individual Environmental Assessment (EA) regarding this proposed project. I requested this in my Elevation Request letter of November 17, 2006 to then-Director O’Mara, and in my December 13, 2006 letter to John Westlake. I respectfully request it again to you Minister Gerretesen directly today. Please require Domtar to prepare an EA on their controversial proposal.

Hydro-electric generating stations -EXEMPTIONS
DRAFT – FOR CONSULTATION PURPOSES This proposal for a regulation is provided solely to facilitate public consultation in accordance with section 16 of the Environmental Bill of Rights, 1993 (EBR). Should the decision be made to proceed with the making of a regulation, comments received during consultation will be considered during the final preparation of a regulation.
Guide to Environmental Assessment Requirements for Electricity Projects
As part of the implementation of the White Paper, in 1998 the government enacted the Electricity Competition Act, 1998. In order to fulfill the White Paper commitments to maintain environmental protection and create a level playing field, changes to requirements under the Environmental Assessment Act were also required. B.4.1.3 Minister’s Elevation At any point in the Environmental Screening Process, if it is determined that a project is likely to have significant negative environmental effects, and that the scope and scale of these effects are such that an individual EA is warranted, the Minister of the Environment may of his or her own initiative require that a project be made subject to Part II of the Environmental Assessment Act (an individual EA). If the Minister requires an individual EA, the proponent will be informed in writing, stating reasons for the decision.
